Miles Seiden Creative ("Miles Seiden Creative," "I," "me," or "my") respects your privacy. This Privacy Policy explains what personal information I collect through milesseiden.com (the "Site") and related communications, how I use and share it, and the choices and rights available to you. By using the Site or providing your information to me, you agree to the practices described here.

1. Information I Collect

I collect information in the following ways:

A. Information you give me directly

  • Contact form submissions (name, email address, phone number, company/organization, and message content)

  • Newsletter or mailing list sign-ups (name and email address)

  • SMS/text opt-ins (phone number and consent record)

  • Information shared during discovery calls, proposals, or client engagements

B. Information collected automatically

  • IP address

  • Browser type and version, device type, and operating system

  • Pages visited, time on page, referring URL, and general usage patterns

  • Cookies and similar tracking technologies (see Section 5)

C. Information from third-party platforms

  • Data passed to me through my customer relationship management (CRM) platform, GoHighLevel, and any

  • integrated SMS or email delivery services

  • Aggregated or anonymized analytics data, if and when I implement an analytics tool such as Google Analytics (see Section 5)

I do not knowingly collect more information than is reasonably necessary for the purposes described in this policy.

2. How I Use Your Information

I use the information I collect to:

  • Respond to inquiries and provide requested information about our services

  • Deliver email newsletters, updates, and marketing communications you've opted into

  • Send SMS/text communications you've opted into (see Section 4)

  • Manage client relationships and engagements through our CRM

  • Operate, maintain, and improve the Site

  • Understand how visitors use the Site (via analytics, where implemented)

  • Detect and prevent spam, fraud, or abuse (e.g., comment spam filtering)

  • Comply with legal obligations

I do not sell your personal information, and I do not share your information with third parties for their own independent marketing purposes.

3. Email Communications

If you sign up for my mailing list [to come], submit a contact form, or otherwise provide your email address, I may send you emails related to my services, including newsletters and promotional content.

Every marketing email I send will:

  • Accurately identify Miles Seiden Creative as the sender

  • Use subject lines that are not deceptive

  • Include my valid email address

  • Include a clear way to unsubscribe

You can unsubscribe from marketing emails at any time by clicking the "unsubscribe" link included in every email, or by contacting me directly at [email protected]. I will honor opt-out requests promptly. Transactional or relationship emails (for example, replying to a question you asked me) may continue even after you unsubscribe from marketing emails, as these are not promotional in nature.

4. Text Messaging (SMS) Communications

When you provide your mobile phone number and opt in, I may send you SMS/text messages related to my services, including appointment reminders, follow-ups, and marketing messages, using my CRM (GoHighLevel) and its connected SMS delivery platform.

Consent. By opting in, you consent to receive automated text messages from Miles Seiden Creative at the mobile number provided. Consent to receive marketing texts is never a condition of purchasing any service from me. Email opt-in and SMS opt-in are collected separately — signing up for one does not automatically sign you up for the other.

Message frequency. Message frequency varies depending on your interactions with me. I keep these messages to a minimum.

Message and data rates. Message and data rates may apply, depending on your mobile carrier and plan.

Opt-out. You can opt out of text messages at any time by replying STOP to any message. You will receive one confirmation message that you have been unsubscribed, and no further messages will be sent unless you opt in again. You may also revoke consent by any other reasonable means, including replying with words such as QUIT, END, REVOKE, OPT OUT, CANCEL, or UNSUBSCRIBE, or by contacting me directly at [email protected]. I will process opt-out and revocation requests within 10 business days.

Carriers. Carriers are not liable for delayed or undelivered messages.

No sharing of SMS opt-in data. No mobile information collected as part of the SMS consent process will be shared with third parties or affiliates for marketing or promotional purposes. All other categories of information may be shared with the third-party service providers described in Section 6, subject to applicable law.

5. Cookies, Analytics, and Tracking Technologies

The Site uses cookies and similar technologies to operate correctly and to understand how visitors use it.

Current: The Site currently uses only essential cookies required for core functionality through LeadConnector.

Planned: I may implement Google Analytics (GA4) in the future to understand aggregate visitor behavior, such as pages viewed, time on site, and general geographic location (city-level, not precise location). Google Analytics automatically masks full IP addresses before storage. Data collected through Google Analytics is retained according to the retention period we configure in our account and is governed by Google's own privacy policy, available at policies.google.com/privacy. If you would like to opt out of Google Analytics tracking across all websites, you can install the Google Analytics Opt-out Browser Add-on.

If I implement Google Analytics or any other non-essential tracking technology, I will update this policy accordingly and, where required by law (including for visitors in the EU/UK), request your consent before such tracking begins via a cookie consent tool.

Do Not Track. Some browsers offer a "Do Not Track" signal. At this time, GoHighLevel does not respond to Do Not Track signals.

6. Third-Party Service Providers

I use the following categories of third-party service providers to operate my business and the Site. These providers act as data processors on my behalf and are contractually restricted from using your information for their own purposes:

  • GoHighLevel (CRM): Stores and manages contact, communication, and engagement data, and facilitates my email and SMS communications. GoHighLevel's sub-processors include cloud infrastructure providers Google Cloud Services and Amazon Web Services, Inc., and communications platform Mailgun for email delivery.

  • SMS delivery platform: Twilio, a carrier-integrated provider, processes and delivers text messages sent through my CRM.

  • Google Analytics (planned): If implemented, processes aggregated usage data as described in Section 5.

I require my service providers to maintain reasonable safeguards for the personal information they process on my behalf, and I have signed applicable data processing agreements where offered.

7. International Visitors: GDPR and UK GDPR

If you are located in the European Economic Area (EEA) or United Kingdom, the following additional information applies to you.

Legal basis for processing. I process your personal information on the following legal bases:

  • Consent — for marketing emails and SMS/text communications

  • Contract — for information needed to deliver services you've engaged us for

  • Legitimate interests — for basic Site security, fraud prevention, and (where implemented) aggregate analytics, balanced against your rights and interests

Your rights. Subject to applicable law, you have the right to:

  • Access the personal information I hold about you

  • Correct inaccurate information

  • Request deletion of your information

  • Restrict or object to certain processing

  • Receive your information in a portable format

  • Withdraw consent at any time, without affecting the lawfulness of processing before withdrawal

  • Lodge a complaint with your local data protection authority (in the UK, the Information Commissioner's Office)

To exercise any of these rights, contact us at [contact email]. We will respond within one month, as required by GDPR/UK GDPR.

International transfers. Because I am based in the United States, your information transferred to me or my service providers (such as GoHighLevel) may be processed outside the EEA/UK. Where required, I rely on appropriate safeguards for these transfers, such as Standard Contractual Clauses or a service provider's certification under the EU-U.S. Data Privacy Framework (and its UK extension, where applicable).

Representative. Until a formal representative is appointed, Miles Seiden Creative serves directly as the point of contact for EU and UK data subjects regarding this policy, reachable at [email protected].

8. California Privacy Rights

This Site is accessible to California residents, and I comply with the California Online Privacy Protection Act (CalOPPA):

  • The categories of personal information I collect are described in Section 1.

  • The categories of third parties with whom I share information are described in Section 6.

  • You may review and request correction of your information by contacting me at [email protected].

  • Do Not Track: This site does not respond to Do Not Track signals, per my CRM's policy.

Miles Seiden Creative does not currently meet the data-volume thresholds that would classify me as a "business" under the California Consumer Privacy Act (CCPA)/California Privacy Rights Act (CPRA). If that changes, I will update this policy to reflect any additional California privacy rights that apply.

9. Children's Privacy

The Site is not directed to children under the age of 13, and I do not knowingly collect personal information from children under 13. If I learn that I have inadvertently collected such information, I will delete it promptly. If you believe a child under 13 has provided me with personal information, please contact me.

10. Data Retention

I retain personal information for as long as necessary to fulfill the purposes described in this policy, including maintaining my client relationships and business records, complying with legal obligations, resolving disputes, and enforcing my agreements. When information is no longer needed for these purposes, I take reasonable steps to delete or anonymize it.

11. Data Security

I use reasonable technical and organizational measures designed to protect your information from unauthorized access, disclosure, alteration, or destruction. However, no method of transmission or storage is completely secure, and I cannot guarantee absolute security.

12. Your Choices

  • Unsubscribe from email: Click the unsubscribe link in any marketing email, or contact me directly.

  • Opt out of SMS: Reply STOP to any text message, or contact me directly.

  • Cookie preferences: Cookes are for essential functionality only, so there's a banner but no opt-in.

  • Access, correct, or delete your information: Contact me at [email protected].

13. Changes to This Policy

I may update this Privacy Policy from time to time to reflect changes in my practices or for legal, operational, or regulatory reasons. I will post the updated policy on this page with a revised "Last Updated" date. Material changes affecting how I use previously collected information will be communicated more prominently, such as by email notice.
